Privacy Policy & User Agreement

xek.ai is provided "AS IS" and "AS AVAILABLE."

You expressly acknowledge and agree that:

• Use of xek.ai is entirely at your own risk
• We make no guarantees regarding accuracy, performance, uptime, results, reliability, or suitability for any purpose
• Outputs generated by the Application, including ad copy, creative insights, competitor data, and performance predictions, may be incomplete, inaccurate, outdated, or incorrect
• We disclaim all warranties, express or implied, including but not limited to:
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or availability of data or outputs

To the maximum extent permitted by law, xek.ai, its founders, owners, officers, employees, contractors, partners, and affiliates shall not be liable for:

• Any direct, indirect, incidental, consequential, special, punitive, or exemplary damages
• Loss of revenue, profits, customers, data, business opportunities, or goodwill
• Decisions, actions, campaigns, advertisements, or outcomes based on use of xek.ai
• Service interruptions, bugs, errors, delays, or data loss
• Unauthorized access, breaches, or third-party misuse

This applies even if we were advised of the possibility of such damages.

If liability cannot be fully excluded under applicable law, our total aggregate liability shall not exceed the amount you paid to use xek.ai (if any), or $0 CAD, whichever is greater.

You are solely responsible for:

• Any data you upload, connect, scrape, analyze, or generate through our platform
• How outputs, insights, ad copy, or recommendations are used in your marketing campaigns
• Compliance with advertising laws, platform policies (Meta, Google, TikTok, etc.), intellectual property rights, and regulations

You agree to defend, indemnify, and hold harmless xek.ai and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the Application
• Your violation of this Agreement
• Your violation of any law, regulation, or third-party rights

We may collect and process:

• Account information (email, identifiers)
• Usage data, logs, metadata, and analytics
• User-submitted content, product URLs, ad data, competitor information, and generated outputs

Data may be used to:

• Operate, maintain, and improve xek.ai's ad intelligence and generation features
• Monitor performance and prevent abuse
• Provide support and communication
• Comply with legal obligations

We do not guarantee data retention and are not responsible for loss or deletion of data.

xek.ai integrates with and relies on third-party services, platforms, APIs, and data sources, including ad platforms (Meta, Google, TikTok), AI models, and e-commerce platforms.

We are not responsible or liable for:

• Third-party data accuracy, availability, or legality
• Service outages, API changes, or discontinued access
• Any damages arising from third-party services

Your use of third-party services is governed by their own terms and policies.

While reasonable safeguards are implemented, no system is completely secure.

You acknowledge and accept that:

• Security breaches, unauthorized access, or data leaks may occur
• xek.ai is not liable for damages resulting from events beyond reasonable control

All outputs, insights, recommendations, or information provided by xek.ai are for informational purposes only.

They do not constitute:

• Legal advice
• Financial advice
• Marketing guarantees
• Professional consulting

You are solely responsible for validating and using any information (including generated ad copy, competitor analysis, and creative recommendations) produced by the Application.

We reserve the right to:

• Suspend or terminate access at any time
• Remove content or accounts without notice
• Refuse service for any reason

We are not liable for termination-related data loss or damages.

We may update this Agreement at any time. Continued use of xek.ai after changes are posted constitutes acceptance of the updated terms.

This Agreement shall be governed by and interpreted in accordance with the laws of Canada, without regard to conflict of law principles.
